CAMMY

Terms of Service

Effective: July 10, 2026

These Terms of Service ("Terms") are an agreement between you and CAMMY LLC and govern your access to and use of the Cammy mobile application, websites, content, and related services. By downloading, accessing, or using Cammy, you agree to these Terms.

1. Eligibility and Accounts

You must be at least 13 years old, meet any higher minimum digital-consent age that applies where you live, and be legally permitted to agree to these Terms. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. You must provide accurate account information, keep your credentials secure, and are responsible for activity that occurs through your account.

Guest access and the Cammy App Clip. Some events can be joined without creating an account — for example by scanning a host's QR code or opening a Cammy invite link, which on supported devices may launch the Cammy App Clip, a lightweight version of the app delivered through Apple. If you contribute media as a guest without an account, these Terms, our Community Guidelines, and our Privacy Policy apply to you in full, and the age requirement above applies to you as well. Guest access is available only for events whose hosts have opened them to guests; it does not create an account or profile, does not give you ongoing access to the event or its media, and may be limited, capped, or withdrawn at any time. Media you contribute as a guest is subject to the same host controls, moderation, enforcement, and content rules as media uploaded from an account, and you make the same representations about it that Section 3 describes.

2. What Cammy Allows You To Do

Subject to these Terms and our EULA, Cammy lets you create an account, record or upload media, organize content, join or host collaborative events, edit content, generate Edits, pin completed Edits to a public profile if your profile is public, and use available paid features. Some events may use invite, approval, or password-based access controls.

3. User Content, Collaboration, and Your Responsibilities

You retain ownership of the photos, videos, captions, Edits, and other content you submit to Cammy ("User Content"), subject to the rights you grant in these Terms. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, format, transcode, adapt, publish, display, perform, distribute, and otherwise use User Content solely as needed to operate, secure, improve, and provide Cammy and its features, including collaborative events, syncing, thumbnails, rendering, moderation, exports you request, and Edit functionality that you or other authorized users trigger through the product.

If you upload or contribute User Content to a collaborative event, you understand that other permitted event participants may be able to view, interact with, and use that content within the event experience, and hosts and co-hosts may be able to manage or remove shared event media as part of event administration. If you make your profile public and pin completed Edits, those pinned Edits may be visible to other users or viewers of that public profile.

You are solely responsible for User Content and for obtaining and maintaining all rights, licenses, permissions, consents, and releases needed to upload, edit, process, share, export, publish, or allow others to use it through Cammy, including rights relating to copyright, trademark, privacy, publicity, performers, venues, and anyone who appears in your media. You represent and warrant that your User Content and your use of Cammy will not violate law or third-party rights.

If you choose to use Cammy AI Edit or another automated editing feature, you authorize Cammy and its service providers to process the selected User Content, prompts, edit settings, audio selections, metadata, and generated outputs as needed to analyze, plan, render, revise, store, deliver, secure, and troubleshoot the requested feature. You are responsible for making sure you have the permissions needed for Cammy to process media that includes other people, private venues, copyrighted music, or other third-party rights.

4. Prohibited Conduct

You may not:
• violate any law or another person's rights;
• upload content that is defamatory, hateful, harassing, sexually exploitative, fraudulent, or unlawfully violent;
• infringe copyright, trademark, privacy, publicity, or other intellectual-property rights;
• upload content without the permissions or consents required to use, edit, share, or publish it through Cammy;
• impersonate another person or misrepresent your relationship to a person, event, or rights holder;
• interfere with the service, reverse engineer protected components, scrape data, or bypass access controls;
• use Cammy to send spam, malware, scams, or unauthorized commercial messages;
• attempt to access another user's account or content without authorization;
• create new accounts or continue using Cammy to evade a suspension, ban, block, or other enforcement action.

5. Moderation and Enforcement

Cammy has zero tolerance for objectionable content and abusive users. The app provides tools to report content and users and to block abusive users, and we aim to review reports of objectionable content within 24 hours, removing violating content and ejecting offending users where a violation is confirmed. We may review, remove, restrict, or disable content or accounts that we reasonably believe violate these Terms, applicable law, the rights of others, or the safety of users or the service. We may preserve, access, or disclose information if we believe doing so is necessary to investigate abuse, enforce these Terms, respond to copyright or other legal complaints, comply with legal process, or protect rights, property, safety, and the platform.

Cammy is not obligated to pre-screen, monitor, police, or remove content on any particular schedule, and we are not responsible for User Content posted by users. Hosts and co-hosts may also have product tools that let them remove shared event media or block participants in collaborative event spaces. We may take enforcement action with or without prior notice and without liability to you for doing so.

If you believe your content or account was restricted or removed in error, you may contact us at [email protected] and request review. We may, but are not obligated to, review or reverse a moderation or enforcement decision, and nothing in these Terms requires us to restore any content, account, feature, or event access.

6. Purchases, Third-Party Services, and Device Tools

Paid features may be sold as subscriptions or one-time purchases through Apple, Google, RevenueCat, or other authorized billing partners. Pricing, taxes, billing cycles, entitlement rules, and refund rights may vary by platform and jurisdiction. If you use third-party or device-level tools in connection with Cammy, such as SMS, email, share sheets, push notifications, app-store billing, or your photo library, those tools remain subject to the terms, policies, and technical limits of the applicable provider or platform.

Cammy may use third-party infrastructure and processors to provide the service, including, without limitation, Supabase, Cloudflare R2, Amazon Web Services, OpenAI, RevenueCat, Apple services, Twilio through Supabase, Sentry for crash and performance diagnostics, Expo for push delivery, and — only when you choose to share content to them — TikTok and Meta/Instagram. These providers may process User Content, account information, purchase records, device tokens, prompts, media samples, render metadata, diagnostics, or support information only as needed for the relevant Cammy feature and as described in our Privacy Policy.

Current provider roles include: Supabase for authentication, database, storage, and realtime backend services; Cloudflare R2 for object storage; Amazon Web Services for Cammy AI Edit queueing, container hosting, and batch rendering; OpenAI for Cammy AI Edit prompt, frame, and transcript-text understanding; RevenueCat and Apple for in-app purchase receipt validation and entitlement management; Apple Push Notification Service and Expo for push delivery; Twilio through Supabase for phone-code delivery; Sentry (Functional Software, Inc.) for crash and performance diagnostics, which may include device information and account identifiers; and, when you choose to share an Edit to them, TikTok and Meta/Instagram under their own terms and policies.

Cammy-provided music and assets. Cammy may make music tracks, audio, templates, fonts, filters, transitions, and other creative assets available for use within the app ("Cammy Assets"). Cammy Assets are owned by Cammy or its licensors and are licensed, not sold. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Cammy Assets solely as incorporated into Edits you create within Cammy. You may not extract, isolate, download separately, redistribute, sublicense, or use Cammy Assets independently of an Edit, or for any standalone or commercial purpose. Unless we expressly state otherwise for a specific asset, we do not represent or warrant that Cammy Assets are licensed or cleared for your distribution outside Cammy (for example, on TikTok, Instagram, YouTube, or other platforms), and you are responsible for complying with each destination platform's music and content policies and for any additional rights required for your use of an Edit outside Cammy. We may add, modify, or remove Cammy Assets at any time; if we remove an asset your license to it ends, although Edits you have already exported are not affected.

Virtual items and credits. Cammy may offer credits, passes (such as an Event Pass), subscriptions, entitlements, and other virtual items that unlock features such as AI Edits, expanded hosting benefits, or watermark-free exports ("Virtual Items"). Virtual Items are a limited, personal, revocable license to access a feature; they are not your property, not a bank or money-services product, and not stored monetary value. Virtual Items have no cash value, are not transferable, and are not redeemable for cash except where required by law. Virtual Items may expire, and we may create, modify, reprice, revalue, or discontinue Virtual Items or features at any time. Except as required by applicable law, by the app store's rules, or by our Refund Policy, all purchases of Virtual Items are final and non-refundable, and any unused Virtual Items are forfeited when your account is terminated, suspended for violation of these Terms, or deleted.

7. Intellectual Property

Cammy and its software, design, trademarks, branding, and non-user content are owned by us or our licensors and are protected by law. Except for the limited rights expressly granted to you, no ownership or intellectual-property rights are transferred to you.

8. Other Policies

These Terms incorporate the following additional policies, which are part of your agreement with us:

9. Suspension and Termination

You may stop using Cammy at any time. We may suspend or terminate access if you breach these Terms, create legal risk, fail to pay amounts due, repeatedly infringe the rights of others, or misuse the service. You may request account deletion in the app settings. Deleting your account or content does not guarantee deletion of copies already exported, downloaded, copied, re-shared, stored by other users, or incorporated into another user's content or creation where the product allowed that use. Some provisions of these Terms survive termination, including licenses, disclaimers, limitations of liability, indemnity, and dispute provisions.

10. Disclaimers

Cammy is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee uninterrupted availability, permanent storage, perfect accuracy of automated features, successful delivery of invites or notifications, successful removal of every copy of content once it has been viewed, exported, downloaded, copied, or re-shared, or that the service will always be free from bugs, data loss, abuse by other users, or security issues.

Automated and AI-assisted editing features may misunderstand prompts, select moments you would not have chosen, omit requested content, generate imperfect edits or inaccurate on-screen text, titles, or captions, or fail because of media quality, source availability, service limits, provider outages, or safety and abuse controls. You are responsible for reviewing generated Edits before exporting, publishing, or sharing them.

11. Limitation of Liability

To the maximum extent permitted by law, Cammy and its affiliates, officers, employees, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill arising out of or related to your use of the service, User Content, collaborative-event activity, content shared by others, or our moderation or enforcement decisions. Our total aggregate liability for any claim relating to Cammy will not exceed the greater of the amount you paid us for the service in the 12 months before the claim arose or US$100.

12. Indemnity

You agree to defend, indemnify, and hold harmless Cammy and its affiliates, officers, employees, and service providers from claims, damages, losses, liabilities, judgments, awards, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the service, your events, your invitations, your exports or sharing, your violation of these Terms or applicable law, or your violation of any copyright, publicity, privacy, trademark, contract, or other rights of another person or entity.

13. Dispute Resolution and Arbitration

Informal resolution first. Before starting arbitration or filing any claim, you agree to first send us a written Notice of Dispute at [email protected] or the mailing address below that includes your name, the account or username involved, a description of the dispute, and the relief you are seeking. You and we agree to try in good faith to resolve the dispute informally for 30 days after the notice is received before either party may begin arbitration or file a claim.

To the maximum extent permitted by law, if you reside in the United States, any dispute, claim, or controversy arising out of or relating to Cammy, these Terms, or any related policy will be resolved by binding individual arbitration and not in court, except that either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive or equitable relief in court for misuse of intellectual property, confidential information, or unauthorized access to the service.

Arbitration procedure. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, as modified by these Terms. The Federal Arbitration Act governs the interpretation and enforcement of this Section. The AAA rules and filing instructions are available at www.adr.org. Unless you and we agree otherwise, any in-person hearing will be held in the county where you live or in Miami-Dade County, Florida, and either party may elect to proceed by videoconference, telephone, or written submissions where the AAA rules allow. Payment of filing, administrative, and arbitrator fees will be governed by the AAA's rules. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

You and CAMMY LLC agree to waive any right to a jury trial and any right to participate in a class action, class arbitration, representative action, or other consolidated proceeding. Arbitration must proceed on an individual basis only. If this arbitration provision is found unenforceable as to a particular claim or request for relief, then that claim or request must be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, to the extent permitted by law.

Your right to opt out. You may opt out of this agreement to arbitrate by emailing [email protected] within 30 days after you first accept these Terms (or, if this arbitration provision is later added or materially changed, within 30 days after the change takes effect). Your email must come from the email address associated with your account, include your name and username, and state that you are opting out of arbitration. Opting out of arbitration does not affect any other part of these Terms.

To the extent permitted by applicable law, any claim arising out of or relating to Cammy or these Terms must be filed within one year after the claim arose; otherwise, the claim is permanently barred.

14. Governing Law

Except where mandatory consumer-protection law provides otherwise, these Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. You agree that disputes not required to be resolved elsewhere will be brought in the state or federal courts located in Miami-Dade County, Florida. If you live in Canada, Mexico, or another jurisdiction with mandatory consumer rights, nothing in these Terms limits rights that cannot legally be waived.

15. Additional Terms

These Terms, together with the policies they incorporate, are the entire agreement between you and CAMMY LLC regarding Cammy. If any provision is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Our failure to enforce a provision is not a waiver of that provision. You may not assign or transfer your rights or obligations under these Terms without our prior written consent, but we may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice in the app, by email, or by other reasonable means. Your continued use of Cammy after the updated Terms take effect means you accept them.
